But you should....
One thing we know for sure is that nobody ever reads the terms and conditions. So, just to be as helpful as we can be, we'll sum it up for you: Horrify Me promises not to screw you over, but in return we don't want you to screw us over either. Our business together will be pleasant, fun and rewarding for both you and us but you ought to be aware of a few of the "rules" that ensure this outcome.
The QUICK VERSION:
• Horrify Me owns all copyright on all images. This is the law.
• We can show your photos off to others in most cases.
• We have artistic licence in the creation of your photos.
• All bookings need a £50 deposit which is non-refundable.
• All payments must be made prior to the shoot date.
• Gift Vouchers can only be used once, before they expire, and not in conjunction with other offers or vouchers.
• Cancellations made within one month of the appointment date may result in your fee being lost.
• We don't hang around more than half an hour for late arrivals unless you let us know you will be late.
• Alcohol is strictly prohibited from the Horrify Me studio and we will refuse to work with anyone who appears to be under the influence of alcohol or drugs. |

The FULL VERSION:
It is mutually agreed that the following terms and conditions form an integral part of the agreement / contract and that no variation or modification of this contract shall be effective unless accepted by HORRIFY ME (also called “the Photographer” or “the Photographers”) in writing.
Copyright
The 1988 Copyright Act assigns all copyright ownership to the Photographer. It is contrary to the Act to copy, publish, reproduce or store images electronically, unless the express permission of HORRIFY ME has been purchased or otherwise granted. If permission is granted through payment, then transfer of the copyright commences only once payment for the copyright has been made in full.
The Client may not (either personally or via a third party) alter or add to or manipulate a picture by means of computer or any other technique or reproduce a picture in whole or in part as an element within, or as a montage with, another picture.
Display
The Photographer reserves the right for any photograph created during sessions to be displayed in the studio, portfolio, website, social media, or in any other advertising directly associated with HORRIFY ME.
Force Majeure
Every effort will be made to carry out the contract but its due performance is subject to alteration or cancellation by the Photographers owing to any cause beyond their control (eg acts of nature, change in legislation, floods, fire, computer failure, etc). In the unlikely event of total photographic failure or cancellation of this contract by the Photographers, liability shall be limited to a full refund of all monies paid.
Law
These Terms and Conditions shall be governed and construed in accordance with the Laws of England.
Liability
The Photographers shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, our liability (if any) shall be limited to rectifying such defect.
Licence
The Photographers shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The photographers will make all selections from the set of images created in a shoot that will be edited and presented as finished pieces. Not all images will be selected for editing and presentation and the photographers are under no obligation to edit or present any images deemed unfit for this purpose. Under no circumstances will raw images be offered to a client. The Photographers’ judgement regarding the locations, poses and number of photographs used shall be deemed to be correct.
Photographic Prints
All photograph sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct.
All photographs supplied by HORRIFY ME are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. HORRIFY ME cannot accept any responsibility for this gradual image deterioration.
All pictures purchased are presumed to have been received in good condition unless the Client notifies HORRIFY ME in writing of any discrepancy or error within 14 days of receipt.
Payment
All payments must always be made in advance of the shoot date unless otherwise agreed by the Photographers.
Booking
A £50 deposit is required with every booking. This deposit is non-refundable.
Prices
All services and/or goods are supplied at the current prices ruling at the time of supply and are subject to change without prior notice.
Vouchers
Gift vouchers are only good for a single transaction; any remaining amount is not exchangeable with cash or another voucher and will be automatically forfeited. Any additional cost exceeding the value of the voucher will be paid by the redeemer. The gift voucher will be considered null and void if the expiry date has expired or the unique serial code is proven to be invalid. Refunds are not given on date-expired vouchers. This voucher is valid only at HORRIFY ME and is only redeemable for the goods and services specified at the time of purchase. In the event of any dispute, the decision of HORRIFY ME is final. Voucher validation is required by authorized person only. Voucher allows for no travel costs and assumes photoshoots to be done in our Kent studio. Voucher is non-refundable.
Reprint Orders
All re-orders shall be treated as an extension of this contract. No responsibility for error will be accepted unless orders are given in writing.
Refund Policy
We will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.
Once an order has been placed, we will not offer a refund. We may at our discretion allow you to place an order for different products with the same value. This will not affect your statutory rights.
Cancellation Policy
Up to one month before the date of your photoshoot – Upon receiving a cancellation notice in writing HORRIFY ME will reimburse any monies paid in full minus £50 non-refundable deposit amount.
Less than one month before date of your photoshoot – If cancelling your contract less than one month prior to the date of the photoshoot all monies paid will be retained by HORRIFY ME.
Retouching
The final output and finish of any image that is re-touched will be at the photographers discretion.
Appointment Attendance
Clients who fail to show up for their appointment will automatically forfeit their fee unless they contact HORRIFY ME to advise of a problem or situation which has prevented them from attending. If attendance is prevented for a legitimate reason (for example involved in a car crash, unexpected sickness, etc) then we may at our discretion allow you to rebook without penalty.
Late Arrivals
HORRIFY ME expects all clients to arrive on time according to the agreed start time of the session. The photographers will only wait for thirty minutes for late arrivals. Any late arrivals more than thirty minutes late may lose their shoot and forfeit their fee unless an effort has been made to contact HORRIFY ME to advise of a late arrival.
Intoxication
HORRIFY ME expects all clients to arrive sober! Alcohol is strictly prohibited from the workshop / studio at all times and we will refuse to work with anyone who appears to be under the influence of alcohol or drugs. Anyone who arrives intoxicated will be asked to leave the premises immediately and no refund will be offered under these circumstances.
Health and Safety
The photographers will advise you on safe ways to work in the studio environment. Under no circumstances must you touch any equipment or enter any rooms unless you have specifically been asked to do so. Any person found to be in conflict with this condition will be asked to leave and no refund will be given.
HORRIFY ME reserves the right to amend these Terms and Conditions without prior notice.
